This crime is not specified on the relationship of the two parties.

Such a term is used for the violence that is used within certain special relationships like to the children, spouse, former or current boyfriend or girlfriend, other family members or the people one is living with (roommates, landlords or tenants).

Thus, in any case where a battery is committed against these people, it takes the form of a special type named domestic battery.

As per the regulation of California Penal Code Section 243(e)(1) any crime attempted on the category mentioned above is to be penalised. A maximum of 364 days in the country jail and a fine of $2,000 is chargeable as a penalty.

ARE THERE MORE FORMS OF BATTERY?

Another form of Battery which is used in case of physical violence or that which may create an injury to a person in relation is referred to as “Aggravated Battery”.

Committing an act of causing corporal injury on the spouse is considered a serious battery crime. The defendant can be penalised with a possible sentence of about four years in state prison and an approximate fine of $6,000.
